New law taking effect January 1, 2024 that allows Camera Speeding tickets in California

With TBD, you do not have to go to court. Officers do not receive extra pay to do the extra paperwork required for Trial by Declaration, and when they do not submit the declaration on time, the court automatically dismisses your case. It is also easier to fully present your defense in writing compared to a court trial. Additionally, with TBD you have 2 chances to win, instead of just one, if you go straight to a court trial. You can still request for traffic school even if you lose the TBD, and the court will usually allow it.

Ticket Ninja prepares each TBD defense by hand and we do not use any automated software to generate the TBD defense. Each TBD defense is custom made based on the information you provide to us. If anything is not clear, we will contact you personally and get additional information from you, before we finalize the defense paperwork.

You just need to print it out, sign it, and mail to the court with the bail payment(equal to the fine amount). When we send the prepared TBD to you by email, we will include detailed instructions on how to submit the defense package to the court.  If you have any questions, just reply back to our email with the questions you have.  We respond to every email that we receive in a timely manner.

On the average, it will take about 2 to 3 months, for the court to send you a Notice of Decision letter.  During Covid-19, it may take a little longer.

Once you have received a “Not Guilty” or “Dismissed” verdict on the TBD, there is nothing more you need to do. The court will send out a refund check for the full bail amount to you within 60 days, and you will have no points on your record and no need to do traffic school.

Many courtesy notices will not mention TBD, or they are written in such a way that many people will think that they are not eligible to use TBD. As long as your ticket is not a midemeanor ticket(DUI, wreckless driving, etc), by California law you may use TBD. Even for over 100 mph tickets, you can still use TBD, as long as you ask for TBD at the mandatory appearance.

It is sad that it seems that many courts actively discourage people from using the Trial by Declaration process. However, this is understandable given that this process requires a lot more paperwork and manpower for the court to administer.

Traffic School FAQ

You are eligible for traffic school once every 18 months.

Even if you lose the Trial by Declaration(TBD), you may still request traffic school, and usually the court will allow it.

The courts make a $64 traffic school referral fee whenever they allow you to take traffic school.

The judges will have discretionary powers to allow you to take traffic school and they will often do that, if you make a request.  The court also makes a traffic school court referral fee of $64 when they allow you to take traffic school.

The court fee for traffic school is usually $64 for most courts.

Online traffic schools typically charge around $10 to $20. They are very easy to find on the internet by just doing a search for “California online traffic school”.  Most people can complete the full online course in 1 to 3 hours.  The school will notify the court, once you have completed the course.

The traffic school fee should not be paid at this stage since your ticket may get dismissed.  Also, payment of the traffic school fee at this stage may confuse the court clerk into thinking that you are pleading guilty in your case.  This does not mean that you cannot include request for traffic school language in the TBD write-up.
